Default Does CAN SPAM mean I can spam other people?

CAN SPAM is an acronym for Controlling the Assault of Non-Solicited Pornography and Marketing Act. What it does is that it specifies requirements for those who send commercial email, stipulates penalties for spammers and companies whose products are advertised using spam if they violate the law, and gives consumers the right to ask these emailers to stem their spamming activities.

You can get more information in this link from the Federal Trade Commission.

The term CAN SPAM is actually deceptive to the effect that it appears to allow you to spam. But the gist of the regulation is that commercial emails can be sent out to prospective clients but it has to be done with certain restrictions and specifications like:

-It bans false or misleading header information.
-It requires that commercial email be identified as an advertisement and include the sender's valid physical postal address
-It prohibits deceptive subject lines.

There are other things in the provisions which you can check out yourself to protect your company from being accused as a spammer. Kindly check them out before you start your email campaign to protect yourself.

That's right guys. The law-makers do have a sense of humor! You 'CAN-SPAM', but we'll 'CAN-YOUR-A**'.

Hahahaha... but then this spells trouble for those CPA networks who uses lots of email-advertising, don't it?

Well if they dont follow the regulation, I think they would be in hot water. But I wonder if there had already been any prosecutions so far....

I wonder how much money the common SPAMMERS actually make?

I mean, how many people actually order Viagra as a result of a weird and unsolicited e-mail?

Spammers can be so persistent! I do receive the same emails from them almost daily. Well, I think if the product is something that you can use yourself, I think you might be tempted to check out their products....In this case, its points for them and they might be encouraged - which is bad for us whose inbox is clogged by junk mails.

They pay handsomely i heard. I read an article in the news where a spammer who was prosecuted said to have been living in Manhattan apartment. Initial findings showed that he is earning thousands of dollar a day!

Bullseye affinews. In fact, there was the World's Greatest Spammer by the name of Robert Soloway, 27, who was arrested on counts of mail fraud, wire fraud, e-mail fraud, identity theft and money laundering.

Through his Company “Newport Internet Marketing”, Soloway offers an adveritising service of emailing 20 million email advertisements in 15 days for $500.

Emails were sent from Zombie (infected) Computers since 2003. Emails included the headers of MSN and Hotmail addresses. This later lead to a court case in 2005 and Soloway paying Microsoft $7 million in damages.

Prosecutors are looking for a $773,000 fine from the court. With Soloway’s 4 bank accounts seized by the US goverment, he will still have no trouble paying his lawyer.

Tough huh?
